JAMAICA: Parliament barred from tabling OCG report about Hayles

Jamaica Gleaner / The Supreme Court has ordered Parliament not to table the controversial report by the Office of the Contractor General (OCG) containing allegations of impropriety against West Hanover Member of Parliament Ian Hayles until the matter is fully ventilated in May.

The order was made by Justice Glen Brown during a near three-hour in-camera hearing yesterday.

An application by Attorney General Marlene Malahoo-Forte to have House Speaker Pearnel Charles and president of the Senate, Tom Tavares-Finson, removed as interested parties in the legal challenge brought by Hayles was not heard.

"This is a matter that directly affects the functioning of the Parliament," Malahoo-Forte told The Gleaner , in explaining her presence in court.

Justice Brown indicated that he would hear the application when the case is heard on May 11.

 

Conflict of interest  

The report by Contractor General Dirk Harrison raises questions of conflict of interest, irregularity, and impropriety in relation to the construction of buildings by Hayles and his wife, Charlotte, without approval from the Hanover Municipal Corporation.

The report was to be tabled in Parliament last week Tuesday. However, lawyers for Hayles went to court last week and obtained an order barring any "further publication of the report until further order of the court".
